1. Agreement to Terms

Welcome to ShroudID, operated by ShroudID LLC ("we," "us," or "our").

These Terms of Service ("Terms") govern your use of the ShroudID mobile application (the "App") and all related services.

By creating an account or using ShroudID, you agree to these Terms. If you do not agree, do not use the App.

3. Eligibility and Account

3.1 Age Requirement

You must be at least 13 years old to use ShroudID.

• Users under 18: Must have parent or guardian consent
• Users under 13: Are NOT permitted to use the App

We reserve the right to verify age and terminate accounts that violate this requirement.

3.2 Account Responsibility

You are responsible for:

• ✅ Keeping your login credentials secure
• ✅ All activity that occurs under your account
• ✅ Notifying us immediately if your account is compromised

We are NOT liable for losses resulting from unauthorized use of your account.

3.3 Accurate Information

You agree to provide accurate, current information and to update it when it changes.

False information may result in account termination.

4. Subscription and Payment Terms

4.1 Free Trial

ShroudID offers a 14-day free trial of premium features.

• ✅ No credit card required to start trial
• ✅ Full access to all premium features
• ✅ Automatically ends after 14 days unless you subscribe

If you do NOT subscribe: You will lose access to premium features but retain your account and basic features.

4.2 Premium Subscription Plans

After the free trial, you may subscribe to:

iOS Pricing (Apple App Store):

• Monthly Plan: $8.99/month
• Annual Plan: $79.99/year ($6.67/month equivalent, save 25%)
• Charged through your Apple ID
• Auto-renews unless cancelled
• Cancel anytime via App Store settings

Android Pricing (Google Play Store):

• Monthly Plan: $6.99/month
• Annual Plan: $59.99/year ($4.99/month equivalent, save 28%)
• Charged through your Google account
• Auto-renews unless cancelled
• Cancel anytime via Google Play settings

Note: Pricing may vary by platform and region. The exact price shown in the app store at the time of purchase is the price you will be charged.

4.3 Payment Processing

• Payments are processed by Apple App Store or Google Play Store, NOT by ShroudID
• Your subscription is managed through your Apple ID or Google account
• You agree to Apple's or Google's payment terms

We do NOT store your credit card information.

4.4 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

• You will be charged within 24 hours before the renewal date
• The renewal charge is the same as your original subscription price (unless we notify you of a price change)

To cancel: Manage your subscription in your device settings (App Store or Google Play).

4.5 Refund Policy

Refunds are handled by Apple App Store or Google Play Store, NOT by ShroudID.

• Contact Apple or Google for refund requests
• We do NOT have access to process refunds directly
• Refund eligibility is determined by Apple or Google's policies

4.6 Price Changes

We may change subscription prices with 30 days' notice.

• You'll be notified via email or in-app notification
• Changes apply to renewals after the notice period
• If you don't agree, you can cancel before the renewal

5. Acceptable Use

5.1 Permitted Use

You may use ShroudID for:

• ✅ Personal medication tracking
• ✅ Wellness journaling
• ✅ AI medication identification (for personal use only)
• ✅ Viewing crisis resources

5.2 Prohibited Use

You may NOT:

• ❌ Use ShroudID for illegal purposes
• ❌ Identify illegal substances or controlled substances not prescribed to you
• ❌ Share your account with others
• ❌ Attempt to hack, reverse-engineer, or exploit the App
• ❌ Scrape or copy data from the App
• ❌ Use the App for commercial purposes without permission
• ❌ Harass, abuse, or harm other users (once community features launch)
• ❌ Post spam, illegal content, or hate speech (once community features launch)

Violation of these terms may result in immediate account termination.

5.3 Community Guidelines (Future)

When community features launch:

• We will moderate all user-generated content
• Content that violates guidelines will be removed
• Users who violate guidelines may be banned
• We reserve the right to remove any content at our discretion

6. Intellectual Property

6.1 ShroudID Ownership

All content, features, and functionality of ShroudID are owned by ShroudID LLC and protected by:

• Copyright laws
• Trademark laws
• Other intellectual property rights

The ShroudID name, logo, and design are our trademarks. You may NOT use them without written permission.

6.2 Your Content

You retain ownership of:

• Medication information you enter
• Journal entries you create
• Photos you upload

However, you grant us a license to:

• Store and process your content to provide the App's services
• Use anonymized, aggregated data to improve the App

We will NEVER:

• Sell your personal content
• Share your identifiable data publicly
• Use your data for purposes other than operating the App

6.3 Feedback

If you provide feedback, suggestions, or ideas about ShroudID:

• We may use them without compensation or attribution
• You waive any claims to intellectual property rights in the feedback

7. Third-Party Services

ShroudID integrates with third-party services:

7.1 Services We Use

• AWS (Amazon Web Services): Data storage and hosting
• AI Service Providers: AI medication identification
• RevenueCat: Subscription management

You agree to their terms and privacy policies when using ShroudID.

7.2 Crisis Hotlines and Resources

We provide links to crisis hotlines and treatment resources (like SAMHSA, 988 Lifeline, etc.).

Important:

• These are external organizations, NOT operated by ShroudID
• We are NOT responsible for their services, availability, or advice
• We do NOT endorse or guarantee the quality of their services
• Contact them directly for help

8. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your data.

Key points:

• Your data is encrypted and securely stored
• You can delete your data anytime (Settings > Data & Privacy)
• We NEVER sell your data
• We comply with CCPA (California) and GDPR (international) standards

9. Disclaimers and Limitation of Liability

9.1 "AS IS" Disclaimer

SHROUDID IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

We do NOT guarantee:

• ❌ The App will be error-free or uninterrupted
• ❌ AI identification will be accurate
• ❌ The App will meet your specific needs
• ❌ Data loss will never occur (though we take precautions)

Use ShroudID at your own risk.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE (SHROUDID LLC, OUR EMPLOYEES, PARTNERS, AND SERVICE PROVIDERS) ARE NOT LIABLE FOR:

• Any indirect, incidental, or consequential damages
• Medical harm resulting from use of the App
• Incorrect AI medication identification
• Data loss (though we take reasonable precautions)
• Service interruptions or outages
• Unauthorized access to your data (beyond our control)

MAXIMUM LIABILITY:

If we are found liable, our total liability is limited to the amount you paid for your subscription in the past 12 months (or $100, whichever is less).

9.3 Medical Liability Disclaimer

WE ARE NOT RESPONSIBLE FOR:

• Adverse health outcomes resulting from medication errors
• Harm caused by relying on AI identification results
• Missed medication doses (even if reminders fail)
• Harm from acting on information in the App without consulting a doctor

YOU ASSUME ALL RISKS associated with managing your medications and health.

10. Indemnification (Your Responsibility)

You agree to defend, indemnify, and hold harmless ShroudID LLC from any claims, damages, or expenses (including attorney fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of applicable laws
• Content you submit (once community features launch)
• Harm to yourself or others from misuse of the App

11. Account Termination

11.1 Termination by You

You may delete your account anytime:

• Go to Settings > Data & Privacy > Delete All My Data
• Your account and all data will be permanently deleted within 30 days

Subscriptions: Remember to cancel via App Store or Google Play to avoid future charges.

11.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in illegal activity
• You abuse the App or harass others
• We are required to do so by law

We will try to notify you, but we reserve the right to terminate without notice in cases of severe violations.

11.3 Effect of Termination

Upon termination:

• You lose access to the App
• Your data will be deleted (subject to backup retention policies)
• Subscription fees are NOT refunded unless required by law

12. Changes to These Terms

We may update these Terms from time to time.

When we make changes:

• We'll update the "Last Updated" date
• We'll notify you via email or in-app notification
• Continued use of the App means you accept the new Terms

Major changes (like new fees or significant policy changes) will require your explicit agreement.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of the United States and the state where ShroudID LLC is registered, without regard to conflict of law principles.

13.2 Dispute Resolution

Informal Resolution:
If you have a dispute, contact us first at [email protected]. We'll try to resolve it informally within 30 days.

Arbitration (If Required):
If we can't resolve the dispute informally, you agree to binding arbitration instead of going to court (except for small claims court).

• Arbitration will be conducted in the United States
• You waive the right to a jury trial
• You waive the right to participate in class action lawsuits

Exceptions:

• Small claims court (for disputes under $10,000)
• Injunctive relief (if necessary to protect intellectual property)

13.3 Severability

If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms remain in effect.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ShroudID LLC.

14.2 No Waiver

Our failure to enforce any provision of these Terms does NOT waive our right to enforce it later.

14.3 Assignment

You may NOT transfer your account or these Terms to anyone else.

We may transfer our rights and obligations to another company (e.g., if we're acquired). You'll be notified if this happens.

15. Geographic Availability

ShroudID is currently available to U.S. residents only.

If you access the App from outside the United States:

• You are responsible for compliance with local laws
• U.S. laws govern these Terms
• Some features may not be available

16. Acknowledgment and Acceptance

By using ShroudID, you acknowledge that:

2. ✅ You agree to be bound by these Terms
3. ✅ You understand the medical disclaimers and risks
4. ✅ You are at least 13 years old (or have parental consent if under 18)
5. ✅ You will use the App responsibly and lawfully

If you do NOT agree, stop using the App immediately.
